  • Reimbursement
    Structure:
    Out-of-network emergency
    providers may bill the insurer directly. Insurers must reimburse them
    based on one of the highest rates among:

    in-network rate for similar services,
  • The
    usual and customary rate,
  • The
    Medicare reimbursement rate.
  • Reporting
    Requirement:
    The Department of Insurance
    must evaluate the effectiveness of dispute resolution practices in
    surprise billing cases and report to the Governor and General Assembly
    within a year of the Act’s implementation.
  • South Carolina (Medical Debt Consumer Reporting) HB 32412025-2026 Bill 3241: Consumer credit reports – South Carolina Legislature Online

  • The
    bill prohibits consumer credit reporting agencies from including medical
    debt and any irrelevant information in consumer credit reports. Key
    provisions include definitions of consumer-related terms, processes for
    investigating violations, and penalties for agencies that fail to comply.
