Here is the information that was shared with me from the MSSNY. I will also share the draft letter of opposition in this thread once it is completed.
For the third straight year, the Assembly and Senate have passed legislation that would greatly increase the damages awardable in wrongful death action. One actuarial study has estimated that this bill would prompt a 40% increase on top of New York’s already exorbitant medical liability insurance costs. The adverse impact of our community healthcare infrastructure is why Governor Hochul has vetoed the 2 previous versions of this bill. The latest version of the bill make some changes to reduce the retroactive impact and diminish the parties who can sue for these expanded damages, but the practical impact of the bill is the same given the new category of damages that would be awardable.
