Would like to add an item for discussion during today’s I-TACT call:
The Change Healthcare hack continues to disrupt remit delivery and some payments appear to be coming in without access to the corresponding 835. The timeline for initiating Open Negotiation is based on the “date of initial payment or notice of denial,” which could lead to unexpected ineligibility of claims processed during the Change outage. We should discuss whether EDPMA should seek a public notification from CMS providing for initiation flexibility for any such claims. Something along the lines of: “Any services for which an initial payment or notice of denial was transmitted between 2/21/24 through 5 business days after the date on which Change Healthcare reestablishes regular service shall be treated as though the initial payment or notice of denial was transmitted 5 business days after regular service is reestablished for the purposes of initiating Open Negotiation.”
